Do you need an Intellectual Property lawyer to deal with an Infringement?


One of the primary areas of work for intellectual property lawyers is infringement. This is when someone else uses your trademark, patent or copyright without permission, potentially damaging the profit-making ability of your design. In response your intellectual property lawyer will seek to end the infringement and possibly gain you remuneration for any losses you have suffered.



The first approach your intellectual property will adopt will be to write a letter requesting the other party to cease and desist in their activity. If this is successful it can be the quickest and cheapest way of resolving the problem. It can sometimes be worth compromising on any compensation you wish to receive to help effect such a simple resolution.



Should the infringement become contentious your intellectual property lawyer also has the option of seeking a judge's decision on the matter. It is, however, also worth bearing in mind the potential for a cheaper and faster solution to litigation that is now offered through alternative dispute resolution (ADR). Through ADR methods such as mediation and arbitration introduce a neutral third party to the dispute to help reach a solution.



Infringement is always far easier for your intellectual property lawyer to combat if you have had your design protected. In the case of unregistered marks your intellectual property lawyer can act under the law of "passing off" but it is far harder to claim ownership and prove that customers believed they were buying your good, making legal action more expensive.
