In the current economic climate employment solicitors particularly find themselves dealing with claims related to dismissals. There are certain procedures that employers must follow to ensure that dismissals only occur out of necessity and employees are treated fairly. If your employer does not follow the 3-step procedure that entails a written warning, a meeting and then a review meeting, then an employment solicitor could represent you in a case for unfair dismissal.



Employers must have good reasons for cutting jobs and an employment solicitor can also seek compensation for unfair dismissal if this is not the case. In the case of redundancy an employer must provide good business reasons for dismissing staff and use objective selection criteria for choosing who is to lose their job. Unfair dismissal often arises out of discrimination - perhaps on grounds of gender or age or as a result of exercising a statutory right such as requesting flexible working.



An employment solicitor can also bring a claim for constructive dismissal, which occurs when an employee is forced to resign as a result of a breach of contract on their employer's behalf that indicates an unwillingness to abide by its terms.



A departing employee is also required to speak to an employment solicitor when signing a compromise agreement, to ensure they understand their legal obligations. This document sets out a financial sum to be received in return for a guarantee that they will not take legal action against their former employer.
