The first thing an employment solicitor can do is to simply advise you on the options available to you going forward and the likely outcomes and costs of your case. An employment solicitor can advise on cases of dismissal, discrimination and other disputes as well as non-contentious issues such as employment contracts. It is important, however, to be conscious of the fact that any prediction for the development of your claim is dependent on the reaction of your employer and cannot be guaranteed.

When it comes to dismissal, your employer is obliged to follow certain steps that are supposed to guarantee you are treated fairly. This includes the 3-step procedure of issuing a written statement, arranging a meeting and then a further appeal meeting; and the demonstration of valid reasons for your dismissal. If the necessary steps were not followed or you were not treated fairly then your employment solicitor can pursue a claim for unfair dismissal. If you were forced to resign because of a breach of contract on your employer's behalf then your employment solicitor could pursue a claim for constructive dismissal.

To win you compensation for loss of earnings regarding unfair dismissal, constructive dismissal or discrimination, your employment solicitor can obtain a tribunal hearing. However, employers are often keen to avoid the expense and publicity of such a hearing so your employment solicitor may be able to reach a settlement before a hearing or arrange for an alternative forum for a decision, such as mediation or arbitration.
